2. Definitions
Platform: The Stock Mall website or mobile application.
Seller: Any person or entity offering products for sale through the platform.
Buyer: Any person purchasing products through the platform.
User: Any individual or entity using the platform in any capacity.
3. Nature of the Platform
Stock Mall operates as an electronic marketplace connecting sellers and buyers. The platform is not a direct party to any sales transaction and assumes no responsibility for the quality, legality, safety, or conformity of products offered by sellers.
The platform does not hold funds, balances, wallets, or escrow accounts for users. All financial transactions are conducted directly between sellers and buyers.
4. Seller Registration Requirements
Sellers must:
Provide a valid Commercial Registration (for Saudi sellers) or legally recognized business documents (for international sellers).
Provide accurate and complete business information.
Refrain from listing products that are:
Counterfeit or fake.
Infringing intellectual property rights.
Prohibited within the Kingdom of Saudi Arabia.
Comply with the regulations of the Zakat, Tax and Customs Authority (ZATCA) when applicable.
The platform reserves the right to suspend or terminate any violating account without prior notice.
5. Seller Obligations
Sellers are responsible for:
Providing accurate product descriptions.
Ensuring product images match the actual product.
Guaranteeing product quality, safety, and freedom from defects.
Complying with applicable laws and regulations.
Processing orders within the specified timeframe.
Informing buyers of any delays.
Bearing return or replacement costs in cases of defects or errors.
6. Subscription, Commissions and Auctions
Subscription and Commissions
Sellers must pay the monthly subscription fee for using the platform.
A commission is charged on each sale completed through the platform.
Commissions are recorded as financial obligations payable by the seller.
The platform does not automatically deduct funds from buyers or sellers.
If the monthly subscription remains unpaid for more than seven (7) days from the due date, the seller account may be temporarily suspended.
Failure to settle outstanding commissions may result in account restrictions or suspension.
Auction Fees
When using auction services, listing fees may apply based on:
Estimated product value.
Quantity of goods.
Product size or nature.
Fees are displayed before listing and become payable once the product is published, regardless of whether a sale occurs.
Auction Rules
Any form of auction manipulation is strictly prohibited.
Artificial price inflation or fake bidding is not allowed.
Suspected manipulation may result in auction cancellation and account actions.
Withdrawal from an auction after it starts or after winning is prohibited without a valid reason.
7. Buyer Obligations
Buyers must:
Provide accurate and complete information.
Pay sellers directly.
Inspect products immediately upon receipt.
Read product descriptions carefully before purchasing.
Refrain from misusing the platform.
Return requests will not be accepted:
After the product has been used.
If the stated difference was clearly disclosed in the product description.
8. Return and Exchange Policy
Exchange requests must be submitted within five (5) days of delivery.
Return requests due to damage or non-conformity must be submitted within twenty-four (24) hours of delivery.
Clear evidence such as photos or reports must be provided.
All return, replacement, and compensation processes are handled directly between the seller and buyer.
The platform bears no financial liability related to returns or refunds.
9. Payments
All payments are made directly between sellers and buyers.
The platform does not manage funds or financial accounts.
The platform is not responsible for transactions conducted outside its scope.
10. Disputes
Disputes must be raised within seven (7) days of product receipt.
Supporting evidence must be submitted.
The platform’s role is limited to review and guidance.
The platform bears no legal or financial responsibility for dispute outcomes.
11. Fraud Prevention
If fraudulent activity or misuse is suspected, the platform may:
Suspend the account.
Restrict services.
Permanently terminate the account.
12. Intellectual Property
All platform content belongs to Stock Mall or its respective rights holders.
Unauthorized copying or use of content is prohibited.
Sellers are solely responsible for any intellectual property infringement related to their products or content.
13. Disclaimer of Liability
The platform is not responsible for:
Product quality or compliance.
Financial obligations between buyers and sellers.
Resale losses or expected profits.
Decisions made by governmental or regulatory authorities.
Any direct or indirect damages arising from platform use.
14. Force Majeure
The platform shall not be liable for delays or failures resulting from circumstances beyond its reasonable control.
15. Termination of Use
Violation of these Terms may result in:
Account suspension.
Removal of products or content.
Permanent account termination.
16. Governing Law
These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. Saudi courts shall have exclusive jurisdiction over disputes arising from the use of the platform.
17. Special Notice
Due to the wholesale and stock-lot nature of many transactions conducted through the platform, certain consumer protection rights applicable to retail consumers may not apply.
18. General Provisions
If any provision is deemed invalid, the remaining provisions shall remain fully effective.
The platform reserves the right to amend this policy at any time.
Continued use of the platform constitutes acceptance of any amendments.
